This is a translation provided for convenience. The agreement is concluded in Russian, and in case of any discrepancy the Russian version prevails.
The Rightsholder offers any legally capable person (the «User») to enter into an agreement on the terms set out below. This document describes the terms on which the right to use the extended version of the «tvista» computer program (the «Program») is granted.
Payment constitutes full and unconditional acceptance of these terms in accordance with Article 438 of the Civil Code of the Russian Federation.
1. Subject of the agreement
The Rightsholder grants the right to use the extended version of the Program on a single device, identified by its device code, for the chosen term. The extended version lifts the free version's channel limit and opens the catch-up archive, simultaneous viewing of two channels and camera connections.
The Program is a media player and contains no channels, TV guides or other broadcast content. The Rightsholder provides no communication services, carries out no television broadcasting and grants no access to TV channels. The User connects their own playlist, obtained independently; the lawfulness of obtaining and using it is the User's responsibility.
2. Price and payment
Cost of the right to use:
- One year (365 days) — $9.90
- One-time purchase (3650 days) — $24.90
Prices are stated in roubles of the Russian Federation and include all applicable taxes. Payment is made by bank card of the Mir, Visa or Mastercard payment systems, or via the Faster Payments System.
Bank card details are entered on the payment provider's secure page and transmitted over an encrypted connection. They are neither passed to nor stored by the Rightsholder. Payment processing complies with the PCI DSS security standard; to confirm a transaction the issuing bank may request 3-D Secure verification.
The receipt is sent to the email address given by the User when placing the order.
3. Activation and term
The right to use is activated automatically once payment is confirmed and is attached to the device code given by the User when placing the order. The term runs from confirmation of payment; if payment is made before the current term ends, the new term is added to it.
Delivery is electronic and requires no shipping: the extended version opens on the device within a few minutes of payment, at the next launch of the app. If it does not, contacting support resolves the matter the same day.
The device code is computed by the app from the device itself. Transferring the right to use to another device is possible by contacting support. Resetting the device to factory settings changes the code — support performs the transfer free of charge.
The right to use is verified over the internet. If the server is unreachable, the extended version keeps working for a further seven days.
4. Conditions of use
The Program requires a device running Android 5.0 or newer, an internet connection and the User's playlist. The Rightsholder does not warrant that any particular stream will work: its availability, speed and format are determined by the playlist provider, with whom the Rightsholder has no relationship.
The Program is provided «as is». The Rightsholder is not liable for losses arising from an inability to use the Program for reasons outside its control, including faults in the User's equipment, communication networks and third-party servers.
5. Refunds
If the extended version did not work and support was unable to fix it, the User may withdraw from the agreement and get their money back. It is enough to write to the support address quoting the order number or device code; no proof of reason is required.
A request is considered within ten days of receipt. A refund is made by the same method and to the same details used for payment; the time to credit depends on the User's bank and usually does not exceed ten working days.
If the Program has already been used, the part of the sum corresponding to unused whole days of the paid term is refunded. On a request made within fourteen days of the payment date, the sum is refunded in full whether or not the Program was used.
From the moment of refund the right to use ends, and the Program on the device reverts to the free version.
